1 Protected project information
Larkwell Editorial treats non-public project information entrusted to us for an enquiry or engagement as confidential. This includes unpublished manuscripts, private correspondence, interview notes, research, business histories, internal reports, project terms, and the identity of a confidential ghostwriting client. Personal information is also governed by the Privacy Policy. A separate signed NDA may set more specific obligations.
2 Limited purpose
We use confidential material only to assess, administer, or perform the authorized project and to address related obligations or disputes. Providing a sample for a quotation does not authorize publication, commercial reuse, or distribution. We do not claim ownership of the client's ideas, unpublished text, or confidential records by receiving or editing them.
3 Access by contributors
Access may be provided to people who need the material for the agreed purpose and are subject to suitable confidentiality duties. If an engagement prohibits subcontracting or requires prior approval, that restriction applies. Before sending particularly sensitive material, the client should identify any access restrictions, professional secrecy requirements, embargoes, or approved locations that the engagement must accommodate.
4 Tools and external processing
Confidential manuscripts must not be placed in a public repository or public generative AI service without the client's specific written authorization and an appropriate assessment of confidentiality and data protection. The proposal should identify any requested restrictions on editing, storage, transcription, plagiarism checking, or other external tools. Required subcontractor permissions and processing terms must be resolved before restricted material is shared.
5 Appropriate submission and handling
Use the agreed communication and delivery method and keep an independent copy of all materials. Initial enquiries should describe the project without unnecessary sensitive detail. Paper originals, irreplaceable records, or particularly sensitive information should be sent only after handling arrangements are confirmed. No method is entirely risk free, and this policy does not represent that ordinary correspondence is legally privileged.
6 Material outside confidentiality
Confidentiality does not apply to information that the recipient can demonstrate was already lawfully known without restriction, becomes public without a breach, is received lawfully from another unrestricted source, or is independently developed without using the confidential material. These exceptions do not permit disclosure of personal information in violation of applicable law or use beyond another continuing contractual restriction.
7 Legally required disclosure
If disclosure is required by law or a valid legal process, we will limit it to what is required and, where legally permitted and practicable, notify the client in time to consider protective steps. Confidentiality does not require a person to obstruct lawful reporting or conceal unlawful conduct. Any restriction on notice imposed by law will be respected.
8 Public credit and samples
We will not identify a confidential client, publish manuscript extracts, or use the work as a testimonial, case study, or portfolio sample without specific permission covering that use. Permission for one use does not authorize another. Publication of the client's book does not automatically authorize disclosure of private drafts, editorial comments, or an undisclosed ghostwriting relationship.
9 Return retention and disposal
The agreement should state whether originals must be returned and when working copies will be deleted or destroyed, consistent with the confirmed retention schedule in the Privacy Policy. Necessary financial, compliance, or dispute records may need to be retained separately with restricted access. Backup copies may remain until their normal replacement cycle. We do not promise immediate deletion from every backup unless that capability has been agreed and verified.
10 Continuing duties and concerns
Confidentiality continues after an engagement ends for the period required by the agreement and applicable law, including protection of qualifying trade secrets while legally protected. Report a suspected disclosure or handling concern to projects@larkwelleditorial.com. We will assess the issue, preserve necessary evidence, and take appropriate steps, including notifications required by applicable law. A separate NDA controls any expressly conflicting term.
